Welcome to the iMoment application of Jubilee Enterprise Public Company Limited ("the Company")
This document sets forth the terms of service and clarifies the guidelines for collecting, using, disclosing, and protecting the personal data of application users ("Users") under the services provided by Jubilee Enterprise Public Company Limited ("the Company"), in compliance with the Personal Data Protection Act B.E. 2562 (PDPA) and related laws.
By registering, logging in, clicking "Accept," or using the application, the User acknowledges that they have read, understood, and fully accepted this document.
1) Definitions

Application: The online system/platform provided by the Company.

User: An individual who registers for or uses the application.

Personal Data: Information that can identify an individual, such as name, phone number, email, and includes photos/videos that may contain images of individuals.

Content: Photos, videos, text, or any files uploaded by the user through the app.

Member: A user who has registered and obtained member status with the company.

Tier: Membership level defined by the Company.

Points: Accumulation points for redeeming benefits according to the Company's conditions.
2) Scope of Service
The Company provides space and a system for users to upload, store, and access content (photos/videos), as well as other functions within the application as defined by the Company.
The Company reserves the right to improve, change, suspend, or terminate part or all of the services, and may notify users through the application as appropriate.
3) Account Registration and User Responsibility
The User agrees to:

Provide accurate, truthful, and current information during registration.

Maintain the confidentiality of their user account and password.

Any use under the User's account shall be deemed to be the User's own action.

Immediately notify the Company if they suspect unauthorized use of their account.

5) Purposes for Collecting, Using, and Processing Personal Data
The Company collects, uses, and processes personal data for the following purposes:

To provide services according to the application's functions.

To store and display user photos/videos.

To improve, develop, and maintain system security.

To contact, notify, and provide support services.

To comply with laws, orders, or requests from government agencies.
6) Conditions for Uploading Photos/Videos and Content Rights
6.1 Consent and Representation of Rights
The User acknowledges and agrees that:

Any content uploaded constitutes consent to the Company for storage, processing, and provision of services for the aforementioned purposes.

The User certifies that they are the rights holder or have been duly authorized by the rights holder, including obtaining consent from individuals appearing in the photo/video.

The Company is not responsible for claims from third parties arising from user uploads.
6.2 Processing for Service Provision
The User agrees that the Company may perform necessary technical operations such as file compression, file format conversion, and data backup to ensure system functionality.
7) Prohibited Uploads and Usage
The User agrees not to upload or use the service in a manner that is:

Illegal or contrary to good morals.

Infringes on personal rights, copyrights, trademarks, or intellectual property of others.

Contains obscene, indecent, violent, or content that causes harm to others/society.
-
Attempts to hack, destroy the system, or compromise security.
The Company has the right to suspend accounts, delete/hide content, or restrict usage immediately without prior notice.
8) Disclosure of Information to Third Parties
The Company will not disclose User's personal data to third parties, except:

With the User's consent.

When required by law.
-
When using system service providers (e.g., Cloud / Server) under a Data Processing Agreement.
9) Data Retention Period (Data Retention) According to Member Tier
The company will collect, use, and retain the personal data of users for 1 year from the date of registration after purchasing products and registering, for the purposes of providing services, member management, and compliance with relevant laws.
After the expiration of the said period, the company will renew data storage annually only if the user maintains their status as a Classic Elite member or higher, meaning users with a total purchase amount of 20,000 Baht or more from Jubilee Diamond. If the user does not maintain such status, the company will delete, destroy, or de-identify personal data according to the standards and methods prescribed by personal data protection laws.
10) Rights of the Data Subject (PDPA Rights)
Users have rights under the PDPA, including:

Request access to/obtain a copy of data.

Request correction of data.
-
Request deletion or destruction.
-
Request restriction of processing.
-
Withdraw consent at any time.
-
Request data portability/transfer (where legally supported).

11) Data Security Measures
The Company employs both technical and administrative security measures, such as access control, encryption, or appropriate measures, to prevent unauthorized access, use, disclosure, or modification.
12) Deleting/Closing User Accounts
Users can request to close their account or delete their data through the channels specified by the Company.
However, the Company may retain certain data as required by law or for dispute resolution purposes.
13) Limitation of Liability
The Company is not responsible for any damages arising from:

Improper use by the User.

Infringement of third-party rights from content uploaded by the User.

Force majeure or events beyond control, such as internet outages, natural disasters, cyber attacks.
14) Document Amendments
The Company reserves the right to amend or revise this document and will notify users via the application. Continued use by the user constitutes acceptance of the amended terms.
15) Governing Law
This document shall be governed by Thai law, and the Thai courts shall have jurisdiction.
